Many clients are under the misapprehension that they cannot pursue debts in Scotland

if their debtors are based abroad say in Europe, United States of America, the Middle East and Far East. Unless a contract states that all disputes are to be resolved via one particular country’s court system (for example must be resolved in Hong Kong), there are internationally agreed rules as to how debtors can be pursued in a jurisdiction such as Scotland.

So, it is entirely possible and cost effective for debtor companies based in other countries to be pursued in the Scottish courts

depending on where the contract was entered into or where the contract was to be performed or where payment was to be made. While the cost of translating court papers and serving them by international registered post or via local court officers must be considered, where you are owed many thousands of pounds a creditor may deem it a good use of their legal budget to incur those costs rather than write off the debt.
