One of the positive features of the Scottish legal system is the ability to swiftly enforce debts once a Court Order has been made for payment.
Once a creditor has a Court Order, they may seek to arrest money due to the debtor in the hands of a bank, a landlord or a construction main contractor. This arrestment process forces third parties to make payment to the creditor which would otherwise have been paid to the debtor.
Inhibition
Inhibition is a way of freezing land or property that the debtor owns, stopping them from selling or otherwise transferring that asset or re-mortgaging it. This is particularly concerning for debtors who are dependent on the sale or the re-finance of land and property.
Attachment
Attachment is another debt recovery. Attachment includes exceptional attachment orders and money attachment orders. For example, the attachment of soft play equipment in a soft play centre which can prevent the operation and running of the business until the debt has been paid or the attachment of newspapers and sweets in a newsagent or even the attachment of flowers within a florist shop.
