In Scotland, a creditor can freeze assets at an early stage in the debt recovery process.
This is generally quite different to the English debt recovery process. A Creditor (or someone who is owed money) can quickly apply to a Scottish court, for a Third-Party Arrestment or an Inhibition. If you have key information to hand, such as the debtor’s full name and bank details, those will assist your solicitor in obtaining an Arrestment Order, which means that money can be frozen in a debtor’s bank account or in the hands of a third party who owes money to the debtor.
